Terms of Service
Effective date: set at launch
These Terms of Service ("Terms") apply to Squishy Cat (the "Game"), made by Backcountry Blueprints LLC, an Arizona limited liability company ("we", "us"). By tapping I Agree when the Game first opens, or by playing, you agree to these Terms, to Apple's Standard End User License Agreement (the "EULA"), and to our Privacy Policy. All three can be read at any time from the Game's Settings (Terms, License, Privacy). If you don't agree, please don't play.
1. Who the Game is for
Squishy Cat is made for a general audience and isn't directed to children under 13. If you are under 18 (or the age of majority where you live), you need a parent's or guardian's permission to play and to make purchases, and they agree to these Terms and are responsible for your use of the Game, including every purchase made on their Apple Account. Parents: you can turn on Apple's Ask to Buy and Screen Time controls to approve or block purchases. Purchases always go through Apple's own confirmation screen.
2. No accounts
The Game has no accounts or logins. Progress is saved on your device. Forever-purchases are tied to your Apple Account and can be restored with Restore Purchases. If you delete the Game without a backup, progress saved only on the device may be lost. Reminders (such as "your free gift is ready") are optional: the Game asks once, at the start, and you can switch them off or on any time in Settings.
3. Purchases and virtual items
- The Game sells optional extras through Apple's In-App Purchase, such as No Ads, Double Rewards, Double Flowers, flower bags, capsule tickets, yarn packs, the Paw Pass, a one-time starter pack, some cats, wardrobe items and upgrades, and weekly deals. Prices are shown before you buy, and Apple processes all payments. There are no subscriptions: nothing renews or charges you again on its own.
- "Used up" items (flowers, tickets, yarn, and items bought with flowers) are consumed when used and cannot be restored. "Forever" items (No Ads, Double Rewards, Double Flowers, cats, wardrobe items, upgrades and the starter pack) can be restored on the same Apple Account with Restore Purchases.
- The Paw Pass unlocks the gold row of prizes for the current season only. The game shows when the season ends. It is a one-time purchase for that season, not a subscription, and it can't be restored. Claim your prizes before the season ends: when a new season starts, points, prizes and the pass start over, and prizes not yet claimed are gone.
- Free rewards (such as the weekly sign-in stamps, missions, the free Paw Pass row, and reward videos) are a bonus. We may change them, and days or rewards you miss can't be claimed later.
- Virtual items are licensed, not sold. They have no cash value, can't be exchanged for real money or for anything outside the Game, and can't be transferred.
- Refunds: all payments go through Apple, and refunds are decided by Apple under its policies. Request one at reportaproblem.apple.com. We can't issue refunds directly. Except where the law says otherwise, a purchase is final once its item has been delivered to your Game.
- Refunded or reversed purchases: if Apple refunds a purchase, or a payment is reversed or charged back, we may remove what it bought. If you've already used or spent it (for example, flowers spent in the shop or tickets used in the Purr-ize Machine), we may instead remove items, currency or progress of about the same value.
- The Purr-ize Machine gives random cats. The chances of each rarity are shown on its Odds screen before you play it. Odds can change for events, and the screen always shows the current ones.
- We may change, re-balance, add or remove virtual items and prices, as long as we don't take away something you already paid for without a refund or a fair replacement, where the law requires.
4. Ads
The Game shows ads, for example between runs, and optional videos you choose to watch for a reward. Ads are set to be non-personalized and family-friendly for every player. Buying No Ads or Double Rewards removes the ads between runs. Optional reward videos stay available, because you choose them, up to a daily limit shown in the Game. Ads are supplied by third parties (Unity LevelPlay and its partners), and we aren't responsible for their content, though we work to keep it family-friendly. Please tell us through our contact form (https://docs.google.com/forms/d/e/1FAIpQLSfzYh0taPFtLswArd1W4gulhT-uNSY4kqaznFZXW0hH7K_5aw/viewform) if you see anything inappropriate.
5. Fair play
Please play fair. You may not:
- cheat, hack, modify or reverse-engineer the Game, or use bots, scripts or changed copies of it;
- exploit bugs or glitches on purpose (please report them instead: we're grateful when you do);
- trick the store or the ads to get things for free, such as faking a purchase or a reward video;
- ask for refunds of items you've already received and used, or do it again and again (refund abuse);
- interfere with the Game, our servers, or anyone else's use of them.
If we reasonably believe you've broken these rules, we may, without a refund except where the law requires one: remove or reset items, currency or progress gained that way; switch off features such as events and new content; or suspend or permanently end your access to the Game. Your license to use the Game ends if you seriously or repeatedly break these Terms.
6. Our content
The Game, including Claire (created by the developer's family and licensed to us), the characters, art, music, names and code, belongs to us or our licensors and is protected by copyright and trademark laws. You may share screenshots and videos of your play for non-commercial purposes.
7. Changes and availability
We may update, change or stop the Game or any feature at any time. We may update these Terms. If the changes are important, we'll show a notice in the Game, and the date at the top will change. Continuing to play after an update means you accept it.
8. Disclaimers
The Game is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Game will be uninterrupted or error-free.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill. Our total liability for all claims about the Game is limited to the greater of (a) what you paid for the Game and in-app purchases in the 12 months before the claim, or (b) US $50. Some places don't allow these limits, so they may not apply to you.
10. Indemnity
If you (or, for a child, the parent or guardian) break these Terms or the law while using the Game, you agree to cover our reasonable losses and costs from claims caused by that, to the extent the law allows.
11. Disputes and governing law
Please contact us first through our contact form (https://docs.google.com/forms/d/e/1FAIpQLSfzYh0taPFtLswArd1W4gulhT-uNSY4kqaznFZXW0hH7K_5aw/viewform). Most problems can be fixed quickly. These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona, except that either side may use small-claims court.
12. Apple
These Terms are between you and Backcountry Blueprints LLC, not Apple. Apple isn't responsible for the Game or its content. Your license to use the Game is Apple's Standard EULA (apple.com/legal/internet-services/itunes/dev/stdeula), which includes the terms Apple requires; if these Terms and the EULA disagree, the EULA wins.
13. General
If any part of these Terms can't be enforced, the rest still applies. Not enforcing a part isn't a waiver of it. These Terms, the EULA and the Privacy Policy are the whole agreement about the Game.
